MIAC UPDATE: 3/20/09 MUST READ

MIAC UPDATE: PLEASE READ AND SPREAD

I (Bryon) was contacted by Major Replogle who is in charge of Missouri’s Criminal Patrol, and oversees the MIAC. He called me on behalf of the Governor to discuss the Modern Militia Movement document. It was a great conversation and he assured me that the intent of the report was to educate police officers, officer safety and alert them of new trends. He also acknowledged that some of the wording could have been better, but that they (MIAC and MO) stand firmly behind this document. I asked him if it would be possible to have a retraction of the document, and he informed me that it was never meant for the eyes outside law enforcement and the officer who leaked the document violated the law. He also reminded me that they are standing firmly behind the document.

On behalf of the Liberty Restoration Project, I offered to bring a team of liberty minded citizens to a meeting to discuss crafting a new document that could be used in its stead. He welcomed the opportunity for us to come out and help educate their team. He also mentioned that not one law enforcement agency has contacted the MIAC to express disdain for the document, and that it appeared that all agencies were appreciative of the information in the document.

I asked Maj. Replogle about the officers that perished by the hands of “militia” members, he cited 3 unfortunate circumstances. I couldn’t write fast enough so please pardon my inaccurate recount of the officers or situation. He mentioned an officer who was killed in the line of duty in 1985 by a member of the Christian Identity Movement (white supremacist group). He cited the David Tate case where Mr. Tate was transporting a van full of explosives and automatic weapons. Tate was pulled over and he began to open fire on the officers, killing one with 11 rounds and another was wounded. Another officer died a year after being shot through a window of his own home (1987). Obviously the threat is real, and paramilitary groups do exist. He also added an example of a theoretical situation, that if he or another officer were to pull over a vehicle that was breaking the law, and they saw a bumper sticker that read “Don’t take my guns away”, they would instinctually use caution, that the person inside MAY have a firearm.

I was also repeatedly assured that no officer would profile vehicles with political information on the vehicles or because of profiling; he commented that the officers take the Constitution very seriously and would never encroach on our civil rights. If we ever felt that our rights were encroached upon, to contact the police department in question and let them know and an investigation will be launched.

With all that being said, he wanted me to inform EVERYONE that they have set-up an email account specifically for the MIAC concerns. He asked me to direct everyone to that email and they will look into everyone’s concerns. That email is:

Now here is my take on this conversation (Maj. Replogle, I hope you still understand my concerns and don’t hate me for this), the MIAC is not going to budge on this document, AND NEITHER ARE WE!!! Our demands are clear and precise. We feel that this document is a potential violation of our 1st Amendment rights to freely express ourselves without fear of being singled out. If Governor Nixon won’t retract this document and apologize for unintentionally slandering an ENTIRE group of AMERICAN’S based on their political beliefs, then we will continue to fight against the state of Missouri until we feel that this injustice is corrected.

So PLEASE, continue to call Governor Nixon and RESPECTFULLY tell them that you won’t tolerate being singled out as a domestic threat and that you will not spend one dime in Missouri, and advocate against his re-election until he fixes this.

We WON’T take this laying down! We won’t continue to slowly let our elected officials strip away what’s left of our liberty. What we are asking is NOT asking much. It wouldn’t take much for them to fix this problem, but their adamant defiance to respond to the people they EMPLOY will not be tolerated any more.

If we don’t stand out ground here, then we will have failed the children yet to come!!!

Operation “Oh, Jay”

Friends of Liberty, it has been a wild few days in Missouri as well as across the nation. The Liberty Restoration Project, Restore The Republic, and several other organizations are coming together to dispute the document released by the MIAC. SO FAR we have managed to confirm the document, launched a national crusade, delivered “Sunshine Law” Requests to MO. Gov. Jay Nixon, MO. Highway Patrol, and SEMA. We have also asked everyone to call the St. Louis economic departments and withdraw their HOTEL reservations for Ron Paul’s Regional Convention and stay in hotels in Illinois instead.

Now comes the next phase, OPERATION: OH, JAY…

This phase is probably THE MOST IMPORTANT at this time. We are asking EVERYONE (In Missouri, or not) to call Missouri Governor Jay Nixon’s office and ask him why he would allow such a generalized and tasteless document to slide off his desk. HOLD HIM ACCOUNTABLE for being the first name on the document in question. We have provided a TEMPLATE to use, feel free to edit. All we ask is that you BE NICE to the people who answer the phones, and ask your questions intelligently and pro-actively. We are looking to form a POSITIVE relationship with the Governor.

Thank you for EVERYTHING that you have done and are currently doing, we are all making a big impact and if we can keep up the effort, we will be able to help law enforcement better educate their staff, and also give our movement a GREAT push toward a long lasting POSITIVE impact on this world!!!

LETTER TEMPLATE

Dear Governor Nixon,

I am constituent of yours, and recently a document with your name on it has been brought to my attention. It is a document release by the Missouri Information Analysis Center (MIAC) and it is titled The Modern Militia Movement. I am sure you are aware of the document, but I must admit, I am terribly concerned by the implications of this document. This report describes many of the philosophies that I believe in, and I take great insult to being referred to as a potential domestic threat, or a “radical extremist” for having views that differ from the two party design. I am concerned about driving my vehicle around if it has “3rd Party” candidates supported, or if I have a “Gadsden Flag” hanging from my house (which were required to fly on EVERY naval vessel in 2002). The next time I am pulled over, I am not going to know if it’s for having a tail-light out, or for having a Ron Paul sticker on my car.

Most of the things listed in this document profile me as a threat to the Police agencies that I support and respect, and to be profiled like this is unacceptable! We demand that you issue a retraction of this document and issue a formal apology to the people of the nation that have been lumped into the same group as white supremacist and hate groups. As a way to continue a positive and constructive relationship, we ask that you invite leaders of our freedom movement into your office and discuss how we can all work together to provide law enforcement ACCURATE and affective information that will help us all.

I am a supporter of Ron Paul/ Chuck Baldwin/ Bob Barr/ 3rd Party candidates and according to this document; it implies that I could be profiled by the police as a domestic threat. In this report, it implies that a non-violent person like me could be viewed as an “extremist” and presumed to think of Police as “Enemies”. I am asking that the Governor retract this document that encroaches my 1st Amendment right, as well as issue a formal apology to the freedom movement.

As a consequence to this report, I am now apprehensive to drive/ live/ or visit your state, and as you know, that would have terrible economic blowback. So would you please pass this on to the Governor. (NOW BE READY FOR QUESTIONS, and remember to be respectful and well thought out).

“I realize that there are people who will dismiss this kind of story as insignificant. They shouldn’t. This is very serious and should be treated as such. Anyone who knows anything at all about history knows that before a state or national government can persecute–and commit acts of violence against–a group of people, they must first marginalize the group from society’s mainstream and categorize it as dangerous.

Rome did exactly that to Christians, as did Mao’s China; Hitler’s Germany did the same thing to Jews; Stalin’s Russia did the same thing to political dissenters, etc. That a State police agency in America would actually infer that people who supported Ron Paul, Bob Barr, or myself in a political campaign are somehow indistinguishable from violence-prone “militias” is beyond insulting: it is a smear campaign, and might should even be regarded as a hate crime!”

CALL Missouri REPS: TIPS AND TEMPLATES

We know that MO Reps are on break this week, but this is still an IMPORTANT time to call and get the word out. We will be back in Jefferson City next week to lobby for this so our Reps. need to be aware of this issue.

First and foremost, we must be respectful and cordial to the people that we are trying to ask for help. We must not be angry or pushy or even appear agitated. This is about asking honest questions about valid, sober concerns. Please do not call anyone any names or use any ad hominem attacks against the person you are talking to or any third party whatsoever. It will turn off your state legislator and seem to validate the content of the MIAC report.

“Hello, my name is ________ and I am a constituent of Senator/Representative ________ calling to speak to him/her about an issue that deeply concerns me, is he/she/’the Senator’(Senators tend to take their position very seriously) available?”

If the legislator you are calling is available:

INTRODUCE YOURSELF, BE CORDIAL, MAKE SURE THEY KNOW YOU ARE THEIR CONSTITUENT:

“Hello, my name is _____ and I live in/at/near ________. Thank you for taking my call. I’m sure you’re very busy so I will take up as little of your time as possible.”

GIVE A ROUGH OVERVIEW OF MIAC AND YOUR CONCERNS:

“I am calling today because I am concerned about a recently leaked report from the Missouri Information Analysis Center. The MIAC is a “fusion center” created to coordinate law enforcement officials at all levels and across the country. What concerns me about this report is that it unfairly characterizes certain peaceful and lawful political activities and organizations as being associated with violent militias, white supremacist groups, as well as domestic terrorist cells.”

IF THIS APPLIES TO YOU, YOU MIGHT SAY SOMETHING LIKE THIS:

“I myself associate with political organizations and support politicians named in this report, and as a law-abiding citizen with no criminal record nor history of violence, I am disturbed to find myself and my friends associated with dangerous criminals.”

Also consider if other groups you associate with but were not mentioned by name in the memo hold political stances listed in the report, such as the Republican Party, Eagle Forum, LRP or whatever conservative or liberty-minded groups are concerned about 2nd Amendment rights, NAU, NAIS, REAL ID, etc. If so–and you think you might be talking to someone who is sympathetic to such views–please mention the fact that other nonviolent political organizations you associate with hold some of the views that were characterized as radical within the memo.

ASK QUESTIONS NOT FOR THE ANSWERS BUT TO GET THEM THINKING:

“Why are peaceful organizations being lumped in with violent radicals with no attempt to clarify that these organizations are indeed peaceful?”

“Where did this “information” come from?”

“What do you think their sources might be?”

“What other political groups could be targeted?”

“Please ask Governor Nixon why his name is at the top of this unnecessarily inflammatory and misleading memo and support a full investigation into the origins of this MIAC report.”(Republicans will like this, Democrats probably not)

For Dems, go with something like, “Please call for a full investigation into this unnecessarily inflammatory and misleading document. This is a clear violation of my civil rights.”

BE PREPARED FOR THEIR QUESTIONS:

They may wish to see this report, it can be found at XXXXX[*not yet sure of the legality of distributing “Law Enforcement Sensitive” material]

They may ask which groups that you associate with were named. Be sure to have an answer that paints the C4L, Libertarian Party, Constitution Party, or liberty movement in general in their true, peaceful, light. Something like “I supported ______ during the recent presidential election. I supported him/her because of my desire for a peaceful foreign policy and a sensible economic system, I have no idea why this report would make people like me out to be a threat to anyone.”

There are already responses from LEO’s concerning our response. They say we are overreacting and that they are not profiling anyone. The best response to give if your Rep/Senator says something like that is to say something like, “Well, it certainly seems to me that any law enforcement officer unfamiliar with these organizations would assume that they were violent or unlawful. There was no attempt made to indicate that named organizations or individuals were indeed peaceful. I find the idea that any nonviolent political organization could be named in such a report without any sort of disclaimer as to the peaceful nature of the organization to be extremely concerning. Who’s next?”

If your Rep/Senator is not available, be sure to leave a message with the person who answered the phone and get that person’s name. Your message should be that you are concerned about the MIAC Report and would like to speak to your Rep/Senator about it. Ask that the person answering the call take down your contact information and ask that the legislator you are trying to contact call/e-mail you back. Remember to be cordial and thank the person for their help.

Liberty Restoration Project delivers “Sunshine Law” request to Jefferson City regarding Police document.

Kansas City, MO. March 16th, 2009:

Today representatives of the Liberty Restoration Project (LRP) hand delivered a “Sunshine Law” request to 3 offices in Jefferson City. The Sunshine Law in Missouri is a version of the Federal Freedom of Information Act that allows groups to petition for information. This request was delivered to Missouri Governor Jay Nixon’s office, Missouri Highway Patrol office and State Emergency Management office. The LRP is operating as a mouthpiece to a national “Freedom Movement” that feels that a document released by the Missouri Information Analysis Center (MIAC) on February 20th, 2009, has placed a peaceful movement into the same groupings as “Paramilitary”, white supremacists, hate groups and unconstitutional Militia. This document was released to the Missouri Highway Patrol offices and was released from the desk of Governor Nixon’s desk. This document was leaked to the public by someone who obtained it from their law enforcement agency.

The document in question is being criticized by the freedom movement because of such generalized information provided in the document. The document was written as a training tool for the police to be able to identify Militia members and protect officers as well and citizens. Instead the document managed to label anyone with a political view that differs from the two party designs. This document indicates current Texas Congressman Ron Paul as an icon for the Paramilitary movement, as well as displaying an inverted American flag, or having copies of documentaries that discuss issues that are relevant to the freedom movement. This document indicates that displaying a 3rd Party bumper sticker, or a “Gadsden Flag”, or even carrying a copy of the United States Constitution could be considered “political paraphernalia”. The freedom movement as a whole feels that this document will allow Missouri police to profile vehicles, individuals, organizations, or even political figures as “radical” or “extremists”, and will infringe upon a person’s 1st amendment right to express their views. The most immediate threat to this peaceful group will come at the end of March when Congressman Ron Paul will hold a regional conference in St. Louis, MO. This conference will bring in hundreds of supporters into Missouri, and now most are fearful of being singled out and profiled against, and potentially having their rights violated by the police, all because of a generalized and poorly informed document.

The Liberty Restoration Project is requesting on behalf of a national freedom movement for a retraction of this document, and a formal apology from the Governor, MIAC, and the Missouri Highway Patrol. The Liberty Restoration Project in Kansas City will extend a hand in drafting information that will not only clarify a position of a freedom movement, but also assist in better informing law enforcement officials in hopes to protect our peacekeeping officers and citizens.

Missouri Sunshine Law Request submitted 3/16/09

Pursuant to the provisions of Chapter 610, RSMo, this letter is written to you, as custodian of records for your various department or office, to request documents from the files of your office or any other documents in your custody, control, or possession.

“Document” or “Documents” means all versions of all copies of any written, recorded or graphic matter, however produced, reproduced, or fixed in a tangible medium of expression, including but not limited to, correspondence , facsimile transmissions,  telegrams, “post-its”, notes or recordings,  deleted or undeleted e-mails ,  any attachments to any e-mails or correspondence,  any instant messages (sent or received),  tape recordings, electro-magnetic or other media, any presentations (whether paper or electronic), of any type of personal or telephone conversations, any audio or video files, or of any meetings or conferences, minutes of meetings, memoranda, intraoffice or interoffice communications, records, studies, tables, charts, drafts, analyses, reports, results of investigations, evaluations, reviews, contracts, agreements, working papers, statistical records, ledgers, books of account, vouchers, bank checks, invoices, receipts, computer data, any scanned images, photographs or text, files or printouts, stenographer’s notebooks, desk calendars, appointment books, daybooks, diaries, photographs (digital or film), any pictures saved or downloaded, sound or video recordings, summaries, pamphlets, compilations, tabulations, or paper similar to any of the foregoing, however denominated and regardless of where located, and includes all matter that relates in whole or in part to the subjects referred to in any document request.  The term “document” shall also include the files in which any documents are maintained, including file jackets, and related exhibit tabs or folders in which any documents are filed or maintained.  If a document exists in multiple or counterpart copies, or additional copies have been made, and the copies are not identical (or which, by reason of subsequent modification are no longer identical), each non-identical copy is a separate “document.”

Request for Copies

By this letter, I am requesting copies of the following documents:

1.                    All documents including, but not limited to, deleted or undeleted emails, which reference the Campaign for Liberty or the Liberty Restoration Project or Ron Paul or Chuck Baldwin or Bob Barr;

2.                    All documents relating to the determination that the Campaign for Liberty or the Liberty Restoration Project or Ron Paul or Chuck Baldwin or Bob Barr may somehow be connected to militia;

3.                    All documents detailing processes for determining threats in the state of Missouri;

4.                    All documents related to Campaign for Liberty or Liberty Restoration Project activities or participants in your possession;

If any portion of these document requests is denied, I am hereby requesting a written statement of the grounds for such denial, including a citation to the specific provision of law under which access is denied.  § 610.023.4, RSMo.
Time is of the essence.  This request is made consistent with the holding in the cases of  Christiansen v. Missouri State Board of Accountancy , 764 S.W.2d 943 and 764 S.W.2d 952 (Mo. App. 1988). Compliance with this document request should be made pursuant to § 610.023.3, RSMo, for the documents described herein.  Therefore, your response to this request is due by Wednesday, March 18, 2009.
