Are liberty lovers being targeted despite the MIAC retraction?

Is Nixon Abusing His Power?

Please see the following letter from a known and trusted patriot in St. Louis, Missouri.

To whom it may concern:
 
Attached you will find a letter from me to Governor Jay Nixon.  In that letter, I ask Governor Nixon to leave me and my friends alone.
 
Here is what happened: I filed a Sunshine Request with Nixon on the past Monday, March 23rd at about 10 am.  My Sunshine Request stemmed from my concern with Nixon over his MIAC “report” and over his videocamera in his office.
 
By 4 pm on this past Monday, members of law enforcement were showing up at my friends’ homes and asking all kinds of questions about me, about my beliefs, about my habits.  I do not think that this is a coincidence that this started right after my request.  It has continued until today – so far at least 7 friends or people I know have been visited by law enforcement. 
 
To be clear, I am the kind of person that Nixon’s MIAC profiled:  I am a Ron Paul supporter and I have opposed the exansion of the Federal Reserve.  And I am generaly conservative. Also, I am sure you know that I am a member of the Missouri Republican Party State Committee.   It seems obvious to me that since My Sunshine Request identified my concern about Nixon’s MIAC “report” that profiled people like me that I may be targetted.
 
In America, a “report” like Nixon’s MIAC report should not be allowed.  Nor should my friends be hassled by cops and investigators about me and who I am.
 
I have retained a lawyer and spoken to my elected officials.  I will not take this kind of abuse lying down.
 
I am sending this to local press and public officials to try to get help in addressing this matter.

Dear Governor Nixon,

This past Monday, March 23,1 faxed you a Sunshine Request due to my concern about the MIAC report and your meetings in your office. My request was faxed to you around 10 am that morning. By about 4 pin that same day, at least two associates or friends of mine were being questioned by law enforcement officers here in the St. Louis area. These law enforcement officers were asking these people about me, my support for Presidential candidate Ron Paul and others aspects of my political positions and beliefs including my opposition to the expansion of the Federal Reserve. Governor Nixon, I am deeply concerned that I am being targeted by law enforcement within hours of my Sunshine Request and critical comments about your MIAC report. I believe that you could have violated state and federal law in the process of all of this. Not content with those visits on Monday, it is now known to me that St. Louis law enforcement officers have visited at least seven (7) of my friends or associates over the past few days. Governor Nixon, please leave me and my friends alone. You have no right to target me or people like me – pro-life, anti-illegal immigration, critical of the Federal Reserve or federal powers – simply because you do not agree with us. I am copying this letter to the local press to try to stop you and your efforts to treat people wrong through abuse of your power. I have also gotten myself a lawyer and am looking into options for protecting myself and/or suing you. And I have spoken to my elected official.

Brief update: Conference in St. Louis/ Update on MIAC Sunshine Letter Requests

Well, the LRP team has returned from the regional c4l conference, stay tuned for a more detailed update and photos from the event!  It can not be denied that our booth was  HUGE success nor that our speech to the Missouri attendees was abundant with energy!

We are also working on the phase two of the MIAC response.  We have received preliminary responses from the Highway Patrol and SEMA (SEMA claims they had nothing to do with the MIAC report, so we have to address that……), but are struggling with the Governors Office at this time.  Nixon’s office is claiming the hand delivered letter was not addressed to them and that the faxed letter never made it to them.  SO I have decided to give them the benefit of the doubt (although I have my suspicions of the truth) and have re-faxed the document today and we will give them an additional three days to respond.  

Of almost equal concern is the fact that we have called and shown up in the Governors Office in person, twice, asking for a face to face meeting with him and have been ignored…  Is it time to start demanding answers?  

The document may have been rescinded, BUT we still need to know who wrote it, why they wrote it, what sources they used to write it and who else they sent this to!  We also need to know that similar documents will not be released!  Should we trust the organization who released the documents to investigate this issue?  Maybe it is time to call for our State Senators to use their supeona powers to get some answers??  A plan of action will be released soon!

Nixon Violates the Law with State Profiling Effort, Complaint Alleges

As many of you know, I’ve been working for the Missouri Libertarian Party as their public relations/spokesperson on the issue of the Missouri Information Analysis Center’s “Strategic Memo” about militia activity.
See the press release below – this is NOT just about third parties. Those who are pro-life, those who oppose illegal immigration, those who oppose federal income taxes are among those listed as either having a motivation for joining an extremist, violent militia or who might already be in a militia.
Remember, the document in question is one of the state’s official training documents for law enforcement officers. We cannot allow this political profiling to be the policy of our state!
Police have too difficult a job and too dangerous a job to permit politics to enter into what they do to protect us.

Civil Liberties Complaint Filed Against Jay Nixon for Abuse of State Law Enforcement
Temporary Restraining Order Sought Against Nixon in U.S. District Court
St. Louis – March 23, 2009 – Governor Jay Nixon is abusing state law enforcement and other taxpayer-funded resources to target pro-life Missourians and others he believes to be political enemies in violation of their civil rights according to a complaint filed today with the Americans Civil Liberties Union (ACLU). Missourians United for Life filed the complaint and is asking the ACLU to apply instantly for a temporary restraining order against Jay Nixon in U.S. District Court.
The complaint was filed in response to a controversial Nixon Administration report issued by the governor’s Missouri Information Analysis Center (MIAC). The Nixon report targets pro-lifers as potential threats to public safety and specifically warns law enforcement that displaying “anti-abortion” material may be a sign of a potential threat. When asked by a reporter about the controversial report, Nixon defended it stating that getting such information was something “we’re going to continue to do.”
“What Governor Nixon is telling Missourians is if you disagree with him on the issue of life or display a pro-life bumper sticker or wear a pro-life pin, you may subjected to action by state law enforcement or your personal information might be sent to a law enforcement analysis center,” said Ed Martin, President of Missourians United for Life. “This is a clear violation of Missourians civil rights. The only intent of such a report by Nixon’s Administration is to harass and intimidate the governor’s perceived political enemies and chill speech and open debate by those who disagree with Jay Nixon on public policy.
Jay Nixon’s Administration released the attached report on February 20, 2009. In addition to pro-life Missourians, the Nixon report targets Christians, conservatives and others.
Missourians United for Life has filed a complaint against Nixon with the American Civil Liberties Union and is seeking a temporary restraining order against him.
“We are asking the ACLU to take action to protect the civil rights of pro-life Missourians,” Martin said. “No Missourian should have to worry that they may be pulled over by the Missouri State Highway Patrol if they place a pro-life sticker on their bumper or attend a pro-life event. Missourians United for Life have a right to disagree with Nixon’s pro-abortion views and we will not be intimidated by his bullying.”

Missouri Libertarian Party Demands Answers: Why Was U.S. Department of Homeland Security’s “Civil Liberties Impact Assessment Template” Ignored in Creation of MIAC “Strategic Memo”?

(Columbia, MO) -  The Civil Liberties Impact Assessment Template (1), a guideline created by the US Department of Homeland Security’s Office for Civil Rights and Civil Liberties, was obviously ignored by the Missouri Information Analysis Center (MIAC) when creating the now-infamous “Strategic Memo” on militia activity.

The document in question is a training memo for law enforcement in Missouri that characterizes certain political views as potential indicators of involvement in extremist, violent militia activity. Among the political views listed are opposition of illegal immigration, opposition to abortion, opposition to federal taxes and opposition to gun control legislation.

The memo also lists displays of support for third parties, like the Libertarian Party, and former presidential candidates Bob Barr (Libertarian) and Ron Paul (Republican) as being among the “paraphernalia” that could indicate involvement in hate-based militia groups.

MIAC is a “fusion center”; a cooperative of local, state and federal law enforcement and intelligence agencies, including the US Department of Homeland Security.  The Department of Homeland Security has a document designed to prohibit the political profiling and other civil rights violations contained in the “Strategic Memo.”

Specifically:

  • Under the “Other Rights” portion of the template, the following question must be considered when considering any program or activity: “Could the program limit protected political or religious expression? Could the program implicitly chill open discourse or a person’s ability to express their beliefs in writing that does not threaten or amount to shouting fire in a theater?”

Because the US Department of Homeland Security is a cooperating agency in the “fusion center’s” domestic intelligence efforts, its regulations and safeguards for citizens should be observed in all activity.

Missouri Libertarian Party spokesman Mike Ferguson asks if these safeguards were considered during the development of the training document. “We want to know if a Civil Liberties Impact Assessment was done at all. Training law enforcement officers to watch for political speech like signs and bumper stickers when trying to determine if someone is part of a violent hate group will, obviously, ‘chill open discourse’ and people’s willingness to express their beliefs. Just knowing you might be profiled in a way that links you to groups like these discourages people from making their voice heard.

“This training document is not only misguided, it is dangerous and clearly violates the safeguards designed to protect our First Amendment rights.”

The Missouri Libertarian Party reiterates its desire to have representatives meet with Governor Nixon, and with the leadership of the Missouri Highway Patrol, the Missouri Information Analysis Center and the Missouri Department of Public Safety. Ferguson states “We want to be part of the solution that keeps our troopers safe, stops the real bad guys and protects our freedoms at the same time.

“Unfortunately, our repeated requests to have that discussion and reach a solution have been rejected so far.”
